About our services
Claritas Legal & Compliance Ltd provides business-to-business employment law and recruitment compliance consultancy services for recruitment businesses, employers and recruitment sector suppliers.
Our services are designed to provide practical support with documents, processes, training, implementation and day-to-day employment and recruitment compliance matters.
All work is subject to an agreed written scope and terms of business.
Regulatory status
Claritas Legal & Compliance Ltd is not authorised or regulated by the Solicitors Regulation Authority and does not operate as an SRA-regulated law firm.
Rachel Davies is a solicitor of England and Wales and is regulated by the Solicitors Regulation Authority in her personal capacity. Services supplied through Claritas Legal & Compliance Ltd are provided by an unregulated company. Rachel’s personal regulatory status does not mean that Claritas Legal & Compliance Ltd is an SRA-regulated firm.
Services provided through Claritas are limited to non-reserved employment law and recruitment compliance consultancy services within the agreed scope of work.
Professional indemnity insurance and SRA Compensation Fund
Claritas Legal & Compliance Ltd does not currently maintain professional indemnity insurance in respect of services provided through the company.
As the company is not authorised or regulated by the Solicitors Regulation Authority, it is not required to maintain professional indemnity insurance complying with the SRA’s minimum terms and conditions for SRA-regulated firms.
Clients should be aware that there is no professional indemnity insurance cover available in relation to services provided by Claritas Legal & Compliance Ltd.
Clients will not be able to make a claim on the SRA Compensation Fund in relation to services provided by Claritas Legal & Compliance Ltd.
Services we do not provide
Claritas Legal & Compliance Ltd does not:
- Conduct litigation or act in the conduct of proceedings
- Represent clients in court or tribunal proceedings
- Exercise rights of audience
- Handle or hold client money
- Undertake reserved instrument activities
- Undertake probate activities
- Carry out notarial activities
- Administer oaths
- Provide services that require authorisation by a legal services regulator
If your matter requires litigation support, tribunal representation, advocacy, reserved legal services or other regulated services outside our scope, we will let you know and recommend that you instruct an appropriately authorised provider.
Employment tribunal and contentious matters
Claritas can provide practical business-to-business support on employment issues, workplace processes, settlement agreements and risk management where these fall within the agreed non-reserved scope of work.
Claritas does not conduct employment tribunal litigation or provide tribunal representation.
Where a matter has become, or is likely to become, formal litigation, we will discuss whether the work falls outside our scope and whether you should instruct an SRA-regulated law firm or other appropriately authorised provider.
Recruitment Ready: Start-Up Setup
Recruitment Ready: Start-Up Setup is provided as business-to-business employment law and recruitment compliance consultancy support.
The scope of the service will be agreed before work begins. Documents and guidance will be prepared by reference to the proposed operating model and agreed setup scope.
Completing the Start-Up Setup service does not create an ongoing advisory relationship unless this is expressly agreed in writing.
Training and insights
Training sessions and Insights articles are designed to provide practical information and support for recruitment businesses and employers.
They are not a substitute for advice tailored to your particular circumstances, documents or business model.
Compliance reviews and regulatory outcomes
Any review, training or implementation support provided by Claritas is intended to help businesses identify risk, improve processes and understand practical next steps.
It does not guarantee any particular result from a regulator, trade body, client, framework provider, audit, accreditation process or third-party assessment.
Where your business needs to meet a specific third-party standard or contractual requirement, the relevant requirements will need to be provided and the scope of our work agreed in advance.
Client relationship and confidentiality
Submitting an enquiry or contacting Claritas does not of itself create a client relationship.
A client relationship will only begin once we have confirmed that we are able to assist, any relevant checks have been completed, and written terms of business and scope have been agreed.
Please do not send confidential documents or sensitive personal information until we have confirmed that we are able to receive them.
